Terms of Service

Please read these terms carefully. By ordering or using any EnixServer service you agree to the conditions below.

1. General provisions

This page sets out the terms and conditions ("Terms") for using the services offered by EnixServer ("EnixServer", "we", "us", "our"), including game server hosting, VPS, dedicated servers, web hosting and domains. By placing an order or using any service you confirm that you have read, understood and accepted these Terms in full.

You can reach us at any time through the support ticket system, live chat or by email at support@enixserver.com. Be aware of fake accounts impersonating EnixServer; official communication only comes from our verified channels.

2. Introduction

This document defines the framework under which EnixServer agrees to provide its products and services. We reserve the right to modify these Terms at any time. Such changes do not constitute grounds for terminating a service or for refusing payment of amounts already due.

3. Orders, payments and billing

Orders are placed online and require complete and accurate client information. EnixServer cannot be held responsible for any problems caused by incorrect details provided by the client. You must read our Privacy Policy before completing an order.

A proforma invoice is generated automatically and sent to the email address you provide; it is also available in your client account and is not a valid accounting document. By placing an order you agree to pay the service fees in advance.

  • Invoices must be paid within 5 business days of issue.
  • A tax invoice in PDF format is issued in your client account after the payment is confirmed.
  • Prices are displayed in euro (EUR); direct and bank payments may be processed in your local currency at the applicable exchange rate.
  • Online payments are accepted through the providers listed at checkout (for example card or PayPal) and are subject to those platforms' terms.
  • After payment is confirmed, services are normally activated automatically, with a possible delay of 1–6 hours for manual verification.
  • An account may be suspended one day after the payment deadline if it remains unpaid, and its data may be removed a few days later.

4. Domain registration

Domain registration takes place after the payment is confirmed. Domain data is transmitted to the relevant registry authorities (for example ICANN, EURid or the applicable TLD registry). ID protection may be available for certain international domains for an additional cost.

.EU domains are provided in line with EURid regulations, and international domains (such as .COM, .NET, .ORG, .BIZ, .INFO) are provided through our registrar partners under the rules of each TLD administrator. By registering a domain you accept the rules of the corresponding registry. Domain registrations are non-refundable.

5. Money-back guarantee and credits

EnixServer offers a 14-day money-back guarantee, issued as credit in your client account.

  • A small processing fee may apply to a refund request; if the service price is equal to or lower than that fee, no refund is issued.
  • Refunds are requested through a support ticket only. Cancelling a service yourself in the control panel disqualifies it from a refund.
  • The refund is calculated as the daily price multiplied by the remaining days, minus the processing fee.
  • Offers, promotional packages and server files are non-refundable.
  • Only one refund is granted per client; a later order that re-uses a refunded amount is non-refundable.
  • You cannot be compensated for downtime caused by announced or unannounced maintenance or by DDoS attacks.

Where a service is unavailable beyond our published availability target in a given month, you may be entitled to account credit calculated in proportion to the downtime, excluding the cases above.

6. Acceptable use

Services may be used for legal purposes only. We may remove or block content that breaches these Terms without prior notice; access is restored once the situation is corrected. Storage is intended for your website and application files, not for file-sharing, torrents or mass-download hosting.

You may not host or transmit illegal material, including but not limited to:

  • copyright-infringing content or unlicensed media (audio, video, software);
  • hacking tools, exploits or content that promotes them;
  • trademark violations, threats, harassment or hate speech;
  • prohibited adult content;
  • malware, viruses or phishing pages;
  • unauthorized collection or storage of personal data.

The following types of scripts are not allowed on shared hosting: proxy or IRC scripts; nulled or cracked software; torrent trackers; top-list or traffic-exchange scripts; file-sharing and mass-storage scripts; URL shorteners; shell scripts (PhpShell and equivalents); insecure mail scripts (such as unprotected FormMail); public chat rooms; and scripts with known security vulnerabilities or that are no longer maintained. Online forms must be protected with a password or an anti-bot mechanism. EnixServer is the sole party entitled to decide what constitutes a breach of these Terms.

7. Email and anti-spam policy

Commercial or bulk email is only allowed to opt-in subscriber lists that include a clear unsubscribe option, a valid sender identity and a working return address. A configured SMTP service must be used; unauthenticated CGI/PHP sendmail for bulk mail is not permitted.

Sending unsolicited commercial messages (spam) is prohibited. A confirmed spam report leads to immediate suspension. A first violation may result in a limited suspension, with reactivation conditional on a written declaration of compliance; repeated or serious violations may result in cancellation without a refund.

8. Fair resource usage

Shared environments are subject to fair-use limits so that performance stays stable for everyone. Accounts are monitored, and excessive consumption may lead to contact or suspension without prior notice. Indicative limits on shared hosting include:

  • Maximum CPU usage: ~10% per account;
  • Maximum RAM usage: 256 MB;
  • Maximum concurrent processes: 20;
  • Maximum MySQL query execution time: 10 seconds, with remote access disabled and up to 8 concurrent connections;
  • PHP: file uploads up to 64 MB, memory limit 128 MB, max execution time 60 seconds, max POST size 64 MB, with raw socket and remote-file operations disabled;
  • Outgoing email rate limited (for example 50 messages per hour).

These limits may be adjusted without notice for security or stability reasons. If you need more resources, you can request a package upgrade or a temporary increase for an additional cost. Heavy or resource-intensive workloads are not suitable for shared hosting and should run on a VPS or dedicated server.

9. Backups

Backups may be performed periodically as a convenience, without any guarantee of completeness or integrity. You are strongly advised to generate and download your own backups of any important data.

10. Client responsibilities

You are responsible for keeping your contact and billing information up to date; we are not liable for issues caused by outdated details. You are responsible for the security of your usernames and passwords and must change them immediately if you suspect they are compromised. You must keep your scripts and applications updated, including resolving reported security issues promptly (typically within 24 hours of being notified). Access logs are available for download from your control panel.

11. Communication

We communicate with you by email and through the support ticket system. By using our services you agree to receive service information, invoices, payment reminders and suspension notices through these channels. Communication is limited to your services; we will not send advertising without your consent.

12. Limitation of liability

To the extent permitted by law, EnixServer is not liable for damages caused by the temporary unavailability of its servers, nor for indirect or consequential losses such as lost profits or lost data. Free technical support is provided for our own services; we are not obliged to support third-party scripts, custom configurations or general programming questions, and we may discontinue free add-ons without notice. Where we provide server files, reported bugs are addressed within a reasonable time (typically up to 7 days). Our total liability for any claim is limited to the amount paid for the affected service in the period concerned.

13. General terms

If you are not satisfied with a service, please contact us first so we can try to resolve the issue; an unresolved complaint does not by itself entitle you to a refund of prepaid services. We will dedicate the necessary resources to investigating security violations. Where a client owns multiple accounts, a serious violation on one may lead to suspension of all of them. Disputes that cannot be settled amicably will be resolved in accordance with applicable law. Abuse of the ticket system or of our staff may result in closure of the account without a refund. Services are delivered electronically and, once payment is confirmed, are normally activated instantly.

14. Sponsored packages

Where EnixServer provides a sponsored or free package, the following rules apply: it may be used for legal purposes only; it is tied to the client it was granted to and is non-transferable; it may not be resold; it may require displaying agreed partnership attribution or links; and it may be removed if it becomes unprofitable, if the required attribution is removed, or if these Terms are breached.

15. Changes to these Terms

We reserve the right to modify these Terms, our packages, prices and website at any time. It is your responsibility to read the current Terms before ordering, and you must agree to them at checkout. The "last updated" date above reflects the latest version.
